Topic Info

Trends in Workplace Law

Athena Koelmeyer, will guide you through some of the emerging regulations that could affect your business. She will explain how complicated contract regulations, the new Adverse Action litigation and the developing concept of 'Triangular Employment' relate to your enterprise.

While appointing contractors rather than hiring employees can represent a significant improvement in efficiency for your business, it can expose your business to liability. Athena will discuss some of the risks and benefits of engaging contractors in your business. 'Sham' contracting is unlawful in Australia and can have significant consequences for employers whose contracting arrangements are found to be illegitimate. Athena will help familiarise you with your rights and responsibilities in relation to the Fair Work Act 2009, particularly the new Adverse Action remedy under the General Protections division.

Athena will also explain the concept and consequences of 'Triangular Employment' and discuss whether it is finally emerging in Australia. Triangular Employment complicates the definition of employer and employee, confusing the onus of liability. It's imperative you understand who has responsibility in your workforce and Athena can help demystify this emerging trend.
