Fair Work Ombudsman reveals the 10 most common excuses made by bosses

When he is investigating breaches of workplace rights, the Fair Work Ombudsman comes across a few pearlers of excuses from bosses for underpaying employees.

1. “That’s all they’re worth”

2. “I can’t afford to pay every entitlement”

3. “That’s what everyone else in the industry pays”

4.  “They agreed to the rate”

5. “They had no experience”

6. “They’re a sub-contractor, so not my responsibility”

7. “We don’t have time to provide pay slips”

8. “I can’t be bothered learning about it”

9. “I didn’t know I had to provide entitlements other than wages”

10. “I applied my own common sense”

Recent Changes to Tax Rules

ATO has released some changes to the way tax is calculated on Back payments, Commissions, Bonuses and similar payments – there are other changes that we thought would be useful for you to know

Back payments, commissions, bonuses and similar payments  

There are new changes to how the tax on Back payments, Commissions, Bonuses and Similar payments are being calculated. 

 The tax table in link provided below replaces PAYG withholding tax table - commission payments and Tax table for bonuses and similar payments.

New PAYG withholding tax tables

From July 1, 2012 the new tax tables have been released. ePayroll’s tax calculations were automatically updated and have been in effect since July 1. This has ensured that you continued to withhold the required amounts of tax from payments made to your employees.

Flood Levy no longer applies

The temporary flood and cyclone reconstruction levy (flood levy) no longer applies from 1 July 2012 and the flood levy exemption tax tables have been removed.

 The new tax calculations in ePayroll take into consideration the removal of the flood levy.

 

Changes to Tax Free Threshold

From 1 July 2012, the tax-free threshold was increased from $6,000 to $18,200. Employees who claim the tax-free threshold will have less tax withheld from their pay, while employees who do not claim the tax-free threshold will have more tax withheld from their pay.

 Remember: An employee can only claim the tax-free threshold from one employer at a time. Generally an employee will claim this from their main source of income.

Changes to Leave Loading

The way that leave loading is taxed has changed from 1 July 2012 as the separate withholding scale for employees who are entitled to leave loading no longer exists. Leave loading paid as a lump sum is now taxed using the tax table for back payments, commissions, bonuses and similar payments including lump sum payments in arrears. If leave loading is paid on a pro-rata basis, then the leave loading is taxed along with regular earnings.

Increase in Minimum Wage

Fair Work Australia released the 2012 Annual Wage Review decision at 10am on Friday the 1st of June. 

The Australian minimum wage has been increased by $17.10 and is now $606.40 per week. This will be in effect on the 1st of July 2012.

Tax Commissioner Michael D'Ascenzo today released the ATO's annual 2011 prosecution figures for tax and superannuation offences.

The ATO's annual 2011 prosecution figures reveal that almost 1200 people were prosecuted and convicted for tax and superannuation offences last year:

  • 48 people were prosecuted and convicted of serious tax crime offences, with sentences ranging from three months to nine years and 11 months. Six of these convictions occurred under Project Wickenby.
  • 1,149 people and 370 companies were prosecuted and convicted for other tax offences. This included failing to lodge a tax return, providing false and misleading information, or receiving a fee for preparing an income tax return when not being a registered tax agent.
